Business interruption insurance and COVID19

A consideration of the impact of recent judgments, where they leave the law in relation to this area and their wider implications and application

Business interruption insurance remains very much in focus, with the Covid-19 pandemic continuing to force many businesses to remain closed.

Issues relating to the construction of business interruption policies have been litigated in jurisdictions across these islands, with the UK Supreme Court recently delivering a significant judgment in Financial Conduct Authority v. Arch Insurance (UK) Ltd and others [2021] UKSC 1 and the Irish High Court giving judgment in Hyper Trust Limited v. FBD Insurance and three other related cases [2021] IEHC 78.

This BICBA webinar briefing considered the impact of those judgements, where they leave the law in relation to this area and their wider implications and application.

The breakfast briefing was chaired by The Hon. Mr. Justice Peter Kelly, retired President of the High Court of Ireland (2015 – 2020) and addressed by Marcus Daly SC of the Bar of Ireland and Andrew Grantham QC of Kings Chambers.
